Welcome to HomeChata. These Terms of Service ("Terms") govern your use of the HomeChata mobile application and website at www.homechata.com ("App" or "Service") operated by Mainali Software Enterprises LLC ("we," "us," or "our"). By downloading, accessing, or using HomeChata, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App. Please revisit this Terms of Service periodically to ensure you are aware of any changes.
You must be at least 13 years old to use HomeChata. By using HomeChata, you represent that you are at least 13 years of age. If you are under 18 years old, you may only use HomeChata with the consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
To use HomeChata, you must create an account. You agree to provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You may register using your Google account or Apple ID. You agree to notify us immediately of any unauthorized use of your account at contact@homechata.com. You will not misuse or share your credentials, misrepresent your identity, or impersonate any person or entity.
HomeChata uses a credit-based system. A credit is consumed each time you search an address and view a neighborhood report.
Every new user receives 1 free credit after creating an account.
After using your free credit, you may purchase additional credits in packs. Pricing and pack sizes are displayed in the App and are subject to change.
All credit packs are one-time purchases. There are no subscriptions, no automatic renewals, and no recurring charges. Purchased credits are added to your account immediately.
If you have remaining credits and purchase another pack, the new credits are added to your existing balance.
Credits are generally non-refundable once purchased. Refunds are subject to the Apple App Store and Google Play Store refund policies. If you experience a technical issue preventing you from using your credits, please contact us at contact@homechata.com and we will work with you to resolve the issue.
We reserve the right to change credit pack prices at any time. Price changes will not affect credits already purchased.
All payments are processed through the Apple App Store or Google Play Store. We do not receive or store your payment card information. Purchases are subject to the terms and conditions of the applicable app store.
HomeChata is a comprehensive neighborhood intelligence platform that empowers home buyers, renters, and individuals to make informed decisions about where they live. By synthesizing data across public safety, environmental quality, demographic context, natural hazard exposure, and community amenities into a single, on-demand report for any address in the United States, HomeChata delivers high-value neighborhood intelligence — aggregated, processed, and presented on a single platform — giving users instant access to insights that would otherwise demand extensive research across fragmented, hard-to-navigate public sources. Behind every report is a sophisticated data infrastructure purpose-built to serve people making one of the most important decisions of their lives.
HomeChata is an informational intelligence tool and is not a real estate brokerage, investment advisor, legal advisor, consumer reporting agency, or background check service. Nothing within the App constitutes real estate, financial, legal, or safety advice.
A HomeChata neighborhood report provides a comprehensive intelligence snapshot across multiple dimensions, including:
HomeChata presents verified, factual data compiled from authoritative sources. The App does not generate opinions, assign scores, issue ratings, or make recommendations regarding any neighborhood, address, or community. Users are solely responsible for drawing their own conclusions from the data presented and for any decisions made in connection therewith.
HomeChata is an independent informational service and is not affiliated with, endorsed by, sponsored by, or operating on behalf of any federal, state, tribal, or local government agency. References within the App or in HomeChata's marketing materials to government agencies — including the Federal Bureau of Investigation (FBI), the U.S. Department of Justice (DOJ), the Federal Emergency Management Agency (FEMA), the U.S. Census Bureau, the U.S. Environmental Protection Agency (EPA), and the AirNow program — are made solely to identify the original source of underlying public data and do not imply any partnership, certification, endorsement, or affiliation with those agencies.
The use of any government source name, logo, or publicly available data within the App is for attribution purposes only. HomeChata is solely responsible for the aggregation, presentation, and organization of source data within the App, and any interpretation or summarization that HomeChata performs is HomeChata's own work product and does not represent the views, positions, or official statements of any source agency.
HomeChata aggregates, processes, and presents neighborhood intelligence data from a broad spectrum of government, institutional, and licensed sources. While we are committed to delivering high-quality, meaningful data insights, the nature of large-scale public data means that no dataset is without limitation. HomeChata does not warrant the absolute accuracy, completeness, or real-time currency of any data presented within the App. Data is refreshed periodically and may not reflect the most recent conditions at any given address. In circumstances where comprehensive data is unavailable for a specific location, contextual estimates or regional data may be presented to ensure a complete and useful experience.
HomeChata presents crime and public safety data sourced from government law enforcement databases and institutional reporting programs. This data is subject to reporting cycles and may reflect conditions from prior periods rather than real-time activity. Coverage and reporting standards vary across jurisdictions, and not all law enforcement agencies participate in national reporting programs, which may result in data gaps in certain areas.
Crime statistics reflect reported offenses only and do not capture unreported incidents. HomeChata presents this data as a factual reference tool only. We do not evaluate, score, or render judgments on neighborhood safety. This information should not be relied upon as the sole basis for any decision related to safety, housing, or relocation.
HomeChata's process for matching an address to its responsible law enforcement agency is based on city and county data, and may not correctly identify the actual reporting agency for certain address types — including those served by tribal, federal, university, or state police jurisdictions, or those in unincorporated or special-district areas. For such addresses, HomeChata may display data for the surrounding city or county rather than the agency actually patrolling the location. Users should verify that the reporting agency named in the report matches the agency they expect to serve that address.
HomeChata delivers registered sex offender proximity intelligence as part of its comprehensive public safety awareness offering, drawing directly from official government sex offender registry programs administered at the state, territorial, and federal levels. Registry data is maintained and updated by individual jurisdictions in accordance with their respective statutory requirements and reporting cycles. As registry standards, geographic coverage, and update frequencies vary across jurisdictions, HomeChata presents this information as a current-as-available reference, which may not reflect the absolute real-time status of any individual registration at the moment of a given search.
This information is provided as a public awareness resource within a broader neighborhood intelligence context. It must not be used to harass, threaten, discriminate against, or take any adverse action against any individual. HomeChata is not a consumer reporting agency as defined under the Fair Credit Reporting Act and does not provide background screening, tenant screening, or employment screening services.
HomeChata presents demographic, economic, and racial/ethnic composition data sourced from the U.S. Census Bureau's American Community Survey (ACS) 5-Year Estimates. ACS data is derived from a rolling statistical sample of households and carries inherent margins of error. HomeChata does not modify, recompute, or derive Census Bureau values; figures shown reflect the source agency's published estimates and are subject to revision in subsequent ACS releases.
Census data is published at the Census Tract level — a geographic area containing approximately 1,200 to 8,000 residents — not at the level of any individual address or property. The figures presented describe the broader census tract surrounding the searched address and may not reflect the specific block, building, or unit. Neighborhoods within a single tract can vary significantly; values shown are area-level statistics, not predictions or representations about any particular property or its residents.
To convert a street address into a Census Tract, HomeChata uses the U.S. Census Bureau's official geocoding service. This service may fail to resolve, or may resolve to a nearby location rather than the exact address entered, for certain address types — including tribal lands, military bases, federal facilities, newly built developments, and some rural addresses. Users should verify that the tract and place names shown in their report correspond to the location they intended. HomeChata does not modify, estimate, or correct the geocoding results returned by the Census Bureau.
Use of demographic data — including race, ethnicity, national origin, family composition, or income — to make, influence, or facilitate any housing decision in violation of the Fair Housing Act or any applicable state or local fair housing law is strictly prohibited. See Section 9 (Fair Housing Compliance) for additional terms governing the use of HomeChata data.
HomeChata presents three categories of data sourced from the Federal Emergency Management Agency (FEMA): flood hazard zone classifications drawn from FEMA's National Flood Hazard Layer (NFHL), federal disaster declaration history drawn from FEMA's OpenFEMA Disaster Declarations Summaries, and natural hazard risk ratings drawn from FEMA's National Risk Index (NRI). All three datasets are made publicly available by FEMA and are presented within the App as published by the source agency. HomeChata does not modify, recompute, or derive FEMA values; figures and classifications shown reflect FEMA's published data and are subject to revision in subsequent FEMA releases.
Flood Hazard. FEMA periodically revises flood maps and zone designations through formal map amendment processes, including Letters of Map Revision (LOMR). A property's flood zone classification may change between FEMA releases. HomeChata's data is refreshed periodically and may not reflect FEMA's most recent map updates. The flood zone designations shown are FEMA's official classifications, presented for informational purposes only. Flood zone designations describe modeled risk and do not guarantee whether flooding will or will not occur at any specific property. Users should verify a property's current flood zone designation through FEMA's official Flood Map Service Center before relying on flood zone information for any insurance, financing, or risk-management decision.
Disaster History. Disaster declaration data reflects only events that have received an official federal declaration from the President or FEMA. Local emergencies, weather events, and other incidents that did not result in a federal declaration are not included. Disaster declaration records reflect historical events and are not predictive of future incidents. FEMA updates its disaster declaration records on its own schedule, and HomeChata's data is refreshed periodically, which may result in a lag between FEMA's most recent record and what is displayed within the App.
Natural Hazard Risk. HomeChata presents a curated selection of hazard risk ratings from FEMA's National Risk Index, prioritized for relevance to typical residential decisions. The data shown does not include every hazard category in FEMA's full NRI dataset. NRI ratings are modeled estimates derived from historical loss data, exposure analysis, and community vulnerability indicators. They represent FEMA's assessment of relative risk and are not predictions, guarantees, or forecasts of specific future events. For a complete National Risk Index profile for any location, users may consult FEMA's official NRI portal.
The FEMA data presented within HomeChata describes historical events, current classifications, and modeled risk assessments only. None of this data constitutes a forecast, prediction, or guarantee regarding the occurrence, severity, or impact of any future flood, disaster, or natural hazard event at any specific location.
HomeChata presents environmental and quality-of-life data, including air quality indicators and nearby points of interest, sourced from institutional monitoring programs and location intelligence providers. Environmental readings reflect area-level conditions and may not capture hyperlocal variations. Amenity information, including business listings, hours of operation, and distances, is approximate and subject to change. HomeChata is not responsible for the accuracy or currency of third-party listings.
Air quality readings reflect conditions at or near the time of the report and do not constitute a forecast or guarantee of future air quality at any location. Air quality can change rapidly due to weather, wildfires, and other transient factors.
HomeChata presents a limited number of nearby amenities in each category, selected on a best-effort basis from third-party location data. The amenities shown may not represent every nearby location in a given category, and a closer or more relevant option may exist but be absent from the source provider's index.
In circumstances where granular data is unavailable for a specific searched location, HomeChata may present contextual estimates or regional approximations to provide a complete and informative experience. Such estimates are clearly informational in nature and may not precisely reflect conditions at the specific address searched.
HomeChata is designed to be a powerful starting point for neighborhood research — not the final word. We strongly encourage users to supplement HomeChata insights with independent research through official government sources, local law enforcement agencies, school districts, municipal websites, and direct engagement with relevant institutions before making any significant housing, real estate, or relocation decisions.
You hereby acknowledge and agree that your use of HomeChata and any reliance on data provided through the App involves risks. You voluntarily elect to use the Service and assume all risks associated therewith. You expressly agree that your use of HomeChata and any decisions you make based on data provided through the App are at your sole risk. HomeChata shall not be liable to you or others for any damages arising from your reliance on App data, including without limitation any decisions related to housing, real estate, relocation, or personal safety.
You agree to use HomeChata only for lawful purposes and in compliance with all applicable local, state, national, and international laws and regulations. You agree not to:
Violation of these Terms may result in immediate termination of your account and legal action. Illegal and unauthorized uses of the App, including unauthorized automated access or data extraction, will be investigated and appropriate legal action may be taken, including civil and criminal proceedings.
HomeChata is committed to full compliance with all applicable federal, state, and local fair housing laws, including Title VIII of the Civil Rights Act of 1968, as amended (the Fair Housing Act). HomeChata prohibits and does not knowingly participate in any discriminatory housing practices.
You expressly agree that you will not use HomeChata data — including crime statistics, sex offender proximity data, demographic data (including race, ethnicity, national origin, family composition, or income), environmental data, or any other information provided through the App — to:
Demographic and racial/ethnic composition data presented within HomeChata reflects statistical area-level information for the surrounding census tract and is not a characteristic of any individual address, property, or resident. The presence of such data within the App does not authorize, and is not intended to facilitate, any practice that would constitute steering, redlining, or any other form of housing discrimination.
HomeChata data is intended to provide objective, publicly available information to assist individuals in making personal decisions. It is not intended to be used as a tool for discriminatory purposes. HomeChata reserves the right to terminate accounts found to be in violation of fair housing laws.
HomeChata and its original content, features, and functionality are owned by Mainali Software Enterprises LLC and are protected by copyright, trademark, patent, and other applicable intellectual property laws of the United States and other countries. All materials on the App are considered property of Mainali Software Enterprises LLC.
Materials that are viewed or downloaded from the App are to be used only for personal, non-commercial use. No materials may be copied, reproduced, modified, republished, uploaded, posted, distributed, or transmitted without prior written consent from Mainali Software Enterprises LLC.
The HomeChata name, logo, and all related marks are trademarks of Mainali Software Enterprises LLC. You may not use these marks without our prior written consent. Data displayed in the App is sourced from third parties and is subject to their respective terms, licenses, and intellectual property rights.
HomeChata generates downloadable PDF reports that summarize the data presented within a neighborhood report. A PDF report is a condensed, portable version of the in-App report and may omit, abbreviate, or truncate content that appears in the App; the App itself contains the complete report for any given address. PDF reports, including their layout, design, organization, and presentation, are the intellectual property of Mainali Software Enterprises LLC. The underlying public data sourced from government and institutional providers remains the property of the respective source agencies.
You may download, save, print, and share PDF reports for personal, non-commercial use, including sharing with family members, real estate agents, lenders, insurers, attorneys, or other professionals assisting you with a housing or relocation decision. You may not resell, redistribute, republish, repackage, or commercially exploit PDF reports or any portion thereof without prior written permission from Mainali Software Enterprises LLC. You may not remove, alter, or obscure any HomeChata branding, disclosures, source attributions, or disclaimer language contained within a PDF report.
A PDF report reflects the data available within HomeChata at the time the report was generated and may not reflect subsequent updates, corrections, or revisions to any source data. For the most current and complete information, refer to the in-App report. All data accuracy limitations, disclaimers, and restrictions on use described elsewhere in these Terms — including those set forth in Section 6 (Data Accuracy and Limitations) and Section 9 (Fair Housing Compliance) — apply equally to data presented within a PDF report. HomeChata makes no representation or warranty regarding the accuracy of any PDF report at any time subsequent to the moment of its generation.
HomeChata's obligations and warranties under these Terms run only to users who have themselves agreed to these Terms. HomeChata has no obligation to, and assumes no liability toward, any third party who receives or relies upon a PDF report through sharing or redistribution.
Any feedback, comments, suggestions, ideas, or other communications you submit to HomeChata through the App, email, or any other channel will be treated as non-confidential and non-proprietary. By submitting such communications, you grant Mainali Software Enterprises LLC a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, and distribute such feedback for any purpose without compensation to you.
If you create an account, you will receive transactional communications from us related to your account, purchases, and important service updates. These communications are necessary for the operation of the service. We do not send promotional or marketing emails.
HomeChata's neighborhood reports incorporate data from the following third-party and government sources. Each named source is the original publisher of the data and the authoritative reference for any verification or further inquiry:
Each source maintains its own data governance, accuracy standards, update cadence, and terms of use. HomeChata accesses these sources through their respective public interfaces, APIs, or data portals and presents the resulting data within the App. HomeChata does not control, supervise, or guarantee the accuracy, completeness, or currency of any source's underlying data, and HomeChata is not responsible for the independent practices, policies, or terms of use of any source agency or provider. Users seeking authoritative or up-to-date information for any of the above categories should refer to the respective source URLs listed above.
HomeChata's use of source agency names, logos, dataset names, and program references is for the limited purpose of source attribution. Such use does not imply any partnership, certification, endorsement, or affiliation between HomeChata and the named entity. See Section 5 (Non-Affiliation with Government Agencies) for additional terms.
HomeChata is constantly evolving, and the form and nature of the Service may change from time to time without prior notice to you. We may stop (permanently or temporarily) providing the Service or any features within the Service to you or to users generally, and may not be able to provide you with prior notice. We reserve the right to create limits on use, restrict access, or suspend or terminate your access to the Service at our sole discretion at any time without prior notice.
HomeChata is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, Mainali Software Enterprises LLC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, that data will be accurate, complete, reliable, or current, or that any errors or defects will be corrected.
You use HomeChata at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
To the fullest extent permitted by law, Mainali Software Enterprises LLC, its officers, directors, employees, agents, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of HomeChata, including but not limited to loss of profits, revenue, data, or business opportunities; property damage or personal injury; reliance on information provided by the App; decisions made based on App data (including housing, real estate, relocation, or safety decisions); interruption of service; unauthorized access to your account or data; errors, omissions, or inaccuracies in App data; or actions of third parties or third-party services.
Our total liability for any claim arising from your use of the App shall not exceed the amount you paid for credit packs in the 12 months preceding the claim, or $100, whichever is less.
This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Mainali Software Enterprises LLC, its officers, directors, employees, agents, affiliates, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
We may terminate or suspend your account and access to HomeChata at any time, with or without cause, with or without notice. Reasons for termination may include violation of these Terms, fraudulent or illegal activity, abuse of the credit system, interference with the App, or violation of fair housing laws.
Upon termination, any unused credits are forfeited and cannot be recovered or refunded.
You may delete your account at any time by contacting us at contact@homechata.com. Account deletion is permanent and cannot be undone. Unused credits are forfeited upon account deletion and cannot be recovered or refunded.
Upon termination, your right to use HomeChata ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by email to the address associated with your account. Your continued use of HomeChata after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically to stay informed about your rights and obligations.
These Terms are governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law provisions.
ARBITRATION: Any disputes arising from these Terms or your use of HomeChata that cannot be resolved informally shall be resolved through binding individual arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, rather than in court. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. Any claims not subject to arbitration shall be resolved in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of such courts.
Before initiating any formal dispute resolution, you agree to first contact HomeChata at contact@homechata.com and attempt to resolve the dispute informally for at least thirty (30) days. Any action concerning a dispute must be commenced within one (1) year after the cause of action accrues, or it shall be permanently barred.
If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent, or if that is not possible, it shall be severed from these Terms.
